Art. 1 - Purpose 

The purpose of La Pépixterie is to manage an online concept store dedicated to designers of bags and small leather goods and to promote their brand.

Art. 2 - General provisions relating to these general conditions

The present general conditions of sale are applicable exclusively to the online sale of products offered by La Pépixterie on the site www.lapepixterie.com.
The GCS are available to customers on www.lapepixterie.com where they can be consulted directly.
The GCS are opposable to the customer, whose validation of the payment of the order is worth adhesion by the purchaser to the GCS in force at the day of the order, whose conservation and the reproduction are ensured by La Pépixterie.

Art. 3 - Description of the products 

La Pépixterie is a website for the online sale of bags and small leather goods (hereinafter the "Product(s)") open to any natural or legal person using www.lapepixterie.com (the "Customer").
The Products presented on www.lapepixterie.com are each the subject of a detailed description mentioning their essential characteristics. The photographs illustrating, if necessary, the products do not constitute a contractual document.
The Products are in conformity with the prescriptions of the French law in force.
Concerning the gift cards sold on the site lapepixterie.com. They are valid only on the lapepixterie.com site, during 6 months as from the date of purchase. They are not nominative.

Art. 4 - Creation of the customer area 

The www.lapepixterie.com website can be freely consulted without registration.
However, the Customer may register on the site by creating a personal customer area. For this purpose, the following information is required: first name, last name, email address and a password. The Customer then has the possibility of adding one or more postal addresses.
It is the Customer's responsibility not to communicate his/her login and password in accordance with the provisions of the article PERSONAL DATA of the present General Terms and Conditions.
After the creation of his/her personal customer area, the Customer will receive an email confirming his/her registration. 

Art. 5 - Ordering

La Pépixterie endeavours to guarantee an optimal availability of its Products. The offers of Products are valid within the limits of available stocks.
At the time of placing an order, the Customer must select the Products chosen, add them to his basket by indicating the Products selected and the desired quantities. The Customer may at any time view and modify the items in his/her order by clicking on "My basket", before validating it.
The Customer undertakes to read the General Terms and Conditions of Sale in force at the time before accepting them and confirming the terms and conditions and any delivery and withdrawal charges prior to payment of his/her order. The validation of the payment of the order implies the irrevocable acceptance of these GTC.

Once the order has been validated, the Customer will automatically receive an email confirming the order. This email confirms that La Pépixterie has received the order, but does not constitute a confirmation of the availability of products.
During the holiday period, the date of dispatch of orders is indicated on the site.

A second email will be sent to the Customer when the articles are ready to be dispatched. This email will confirm the availability of the items ordered. If the products ordered are no longer available, the order will be cancelled and payment will not be made. If only a part of the ordered products is available, the shipment and payment will only concern the available items.

It is agreed that apart from the non-payment of the unavailable product, if this option is requested by the Customer, La Pépixterie is not bound to any cancellation indemnity.

The information communicated by the Customer at the time of the placing of the order (in particular name and address of delivery) engage this one. Thus, the responsibility of La Pépixterie could not in any way be sought in the eventuality where an error at the time of the placing of the order would prevent or delay the delivery.

Art. 6 - Means of payment

The Customer expressly recognizes that any order carried out on www.lapepixterie.com is an order with obligation of payment, which requires the payment of a price against the supply of the ordered Product.

In any assumption, La Pépixterie reserves the right to control the validity of the payment, before the forwarding of the order, by all the necessary means.
The payment of the products will have to be carried out by bank card or electronic wallet (Paypal), according to the indications on the page relating to the payment.

The data of payment are kept neither by La Pépixterie nor by the organization in charge of the financial transaction.

Art. 7 - Payment of the price

The price of the Products in force at the time of the order is indicated in Euros and is inclusive of all taxes, excluding delivery and transport costs. Prices are guaranteed subject to typographical errors. In the event of a promotion, La Pépixterie undertakes to apply the promotional price to any order placed during the period of the publicity made for the promotion.

The price is payable in Euros (€) only. The products purchased are payable in cash in full on the day the order is placed. Delivery of the product will only take place after full payment of the product. The prices offered include the discounts and rebates that La Pépixterie may grant.

The Customer may choose to pay in three instalments without charge by choosing the Alma payment when ordering.

If delivery or transport costs apply, they will be added to the price of the Products and indicated separately before the validation of the order by the Customer. The total amount due by the Customer and its details are indicated on the order confirmation page

Art. 8 - Formation of the contract

The contract between La Pépixterie and the Customer is formed at the time of the sending by the Customer of the confirmation of his order.

The attention of the Customer is particularly drawn to the method of acceptance of the order placed on www.lapepixterie.com. When the Customer places an order, he/she must confirm it using the "double-click" technique, i.e., after selecting the Products added to the basket, the Customer must check and possibly correct the contents of his/her basket (identification, quantity of products selected, price, delivery methods and costs) by clicking on "check order", then validate it and accept these GTC by clicking on "validate payment". Finally, he validates his order after having filled in his bank details and proceeding with the payment. using The "double click" is equivalent to an electronic signature and to a handwritten signature. It constitutes an irrevocable and unconditional acceptance of the order by the Customer.

Art. 9 - Reservation of ownership

La Pépixterie remains the exclusive owner of the Products ordered on www.lapepixterie.com until receipt of the full price, including any shipping costs.

Art. 10 - Shipping and delivery

The online sales offers presented on www.lapepixterie.com are reserved for consumers residing in metropolitan France and the following countries: Austria, Croatia, Finland, Germany, Greece, Ireland, Italy, Malta, the Netherlands, Poland, Portugal, Romania, Belgium, Luxembourg and Spain, Monaco, Switzerland and the United States and Canada.

Delivery means the transfer to the Customer of physical possession or control of the Product. The customer is informed by e-mail of the dispatch of his order.
Shipping costs are indicated on the "Delivery and Returns" page of the website. Delivery times are announced in working days on www.lapepixterie.com when the order is placed. These times include the preparation and dispatch of the order as well as the time allowed by the carrier. Exceeding the delivery time may not give rise to damages. If one or more Products could not be delivered within the time initially announced, La Pépixterie will send an email indicating to the Customer the new delivery date. In period of holiday, the date of forwarding of the orders is indicated on the site.

The Products will be delivered to the address indicated by the Customer at the time of his order. Upon delivery, it is the Customer's responsibility to check that the Products delivered comply with the order. In the event of an anomaly concerning the delivery, i.e. in the event of defective items or items that do not conform in nature (colour reference error), the Customer must as soon as possible, or even on the same day as the delivery, make a request for a return in accordance with the terms and conditions specified in article 11 of these GTC.

Art. 11 - Product returns

If a delivered Product does not give whole satisfaction to the Customer, the latter will be able to return it to La Pépixterie. The Customer will have 14 days to make a request for return as from the date of reception of the order.

In accordance with the article L.221-21 of the Code of consumption and in order to implement this right of retractation under the conditions of the articles L. 221-18 and following of the Code of consumption, the Customer is invited to announce to La Pépixterie his intention to turn over the products and the reasons of this return by informing his number of order and the reason of return:
- for the customers located and carrying out their return since France, via the portal of return https://lapepixterie.shipping-portal.com/rp/ or in the event of inaccessible portal to address an email to lapepixteam@lapepixterie.com. Once the Customer has completed the procedure on this returns portal, he/she will be able to generate and print a returns form to send the parcel back;
- for customers located and making their return from Germany, Austria, Croatia, Finland, Greece, Ireland, Italy, Malta, the Netherlands, Poland, Portugal, Romania, Belgium, Luxembourg, Spain or Switzerland, via the returns portal https://la-pepixterie-ue.shipping-portal.com/rp/ or in case of inaccessible portal send an email to lapepixteam@lapepixterie.com. Once the Customer has completed the procedures on this returns portal, he/she will be able to generate and print out a returns form to send the package back;
- for other countries, the Customer may make a return by sending us an e-mail to lapepixteam@lapepixterie.com with the reason for the return

. The exercise of this right entails the reimbursement of the full price of the products purchased, excluding the initial shipping costs and any customs duties, after qualitative and quantitative verification of the Products returned: the products are returned in their original and complete condition, have not been damaged, washed or worn. The possible accessories (labels attached to the product, shoulder strap, etc...) must be present and returned to La Pépixterie. Note that the bag must not have been worn: the return may be refused if the bag shows traces of use.

La Pépixterie will refund the Customer the amount of the Product within fourteen 14 days from receipt of the Product. In the event of payment by card from PayPal, the posting of the refund on the account could take up to 30 days, according to the banks. This reimbursement will be made automatically to the account associated with the credit card used for the purchase or to the Paypal account used for the payment.

In case of a threefold payment by Alma: if the customer's payment schedule is not yet settled, a partial reimbursement will reduce the amount of the customer's remaining payments. If the amount to be reimbursed is greater than the customer's "remaining balance", the remainder will be credited to the customer's bank account within 3 to 5 days (this period varies depending on the bank).

The expenses of return, in Metropolitan France, will be the responsibility of the company La Pépixterie. The expenses of return except metropolitan France (Europe) are the responsibility of the customer, who will have to pay a fixed amount of 19€. For returns from the United States and Canada, the amount is 70€ (+ possible customs fees).

In the case of a request for reimbursement of a gift card, the Customer will have, as for any other product sold on La Pépixterie, 14 days to make a request for reimbursement, from the date of receipt of the order of the gift card and the receipt of his gift card by email.

Art. 12 - Intellectual property and licence to use the site

La Pépixterie is the sole owner of all the elements present on www.lapepixterie.com, in particular and without limitation, all texts, files, images animated or not, photographs, videos, logos, drawings, models and all other elements of intellectual property and other data or information (hereafter, the "Elements") which are protected by the French and international laws and regulations relating in particular to the intellectual property.

In this respect and in accordance with the provisions of the Intellectual Property Code, only use for private purposes is authorised, subject to different or even more restrictive provisions of the Intellectual Property Code. Any other use constitutes an infringement and is punishable under the Intellectual Property Code.
La Pépixterie reserves the right to take legal action against any person who does not respect the prohibitions contained in this article.

Art. 13 - Liability and guarantee

La Pépixterie could not be held for person in charge of the non-fulfilment of the contract because of the Customer or because of an event qualified as force majeure by the competent courts or the unforeseeable and insurmountable fact of any third party to the present.

The Customer acknowledges that the characteristics and constraints of the Internet do not allow the security, availability and integrity of data transmissions on the Internet to be guaranteed. Thus, La Pépixterie does not guarantee that www.lapepixterie.com and its services will function without interruption or operating error. In particular, their operation may be temporarily interrupted for maintenance, updates or technical improvements, or to change the content and/or presentation.

The Products are covered by the legal guarantee of conformity provided for in Articles L. 217-4 et seq. of the French Consumer Code (in particular L. 217-4 to L. 217-14 of the French Consumer Code), and by the guarantee against hidden defects provided for in Articles 1641 to 1649 of the French Civil Code

Art. 14 - Personal data

For more information concerning the use of personal data by La Pépixterie, please read the Privacy Policy carefully. You can at any time consult this charter of the respect of the private life on www.lapepixterie.com, in the dedicated space.

Art. 15 - General provisions

Entire agreement of the parties
The present General Conditions constitute a contract governing the relations between the Customer and La Pépixterie.

Modification of the conditions
La Pépixterie reserves the right to modify at any time and without notice the contents of the Site or the services which are available there, and/or to cease temporarily or definitively to exploit all or part of the Site. In addition, La Pépixterie reserves the right to modify at any time and without notice the location of the Site on the Internet, as well as the present General Conditions. The GTC applicable to the customer's order are those available on the website at the date of validation of the order.

Complaints - Mediation

Applicable law
These General Conditions are governed, interpreted and applied in accordance with French law.

Acceptance of the general conditions by the client
The Client acknowledges having carefully read the present General Conditions.

By registering on www.lapepixterie.com, the Customer confirms that he/she has read the General Conditions and accepts them, thereby becoming contractually bound by the terms of these General Conditions.
